These Terms and conditions can be found on www.donevhost.com and, among others, nobody can order an account without fulfilling the order thus confirming that he/she is acquainted with and is accepting these. Nevertheless, it will be regarded that these terms and conditions have been fully read and understood by each customer who had bought a hosting package and no customer shall have the right to deny this afterwards.
Transfers
Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult if not impossible to migrate some or all account data. The hosting provider donevhost.com is therefore no responsible to transfer web sites from one server to another. At the same time, the hosting provider donevhost.com shall not be hold responsible for any file/s loss of certain web site due to negligence of it's owner. For these reasons it is your responsibility to always have a copy of your web site contents on USB, hard disk or other suitable device, containing all required files and if need arises to be able to load these on other server.
Content
All services provided by the hosting provider donevhost.com may only be used for lawful purposes.
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of anothers copyright will be expeditiously removed, or access to the material disabled.
Using an account as a backup/storage device is not permitted, with the exception of one cPanel backup of the same account. Please do not take backups of your backups.
Examples of unacceptable material on our servers include:
- Pornographic Material (of any kind)
- Sites that stream copyrighted material, either directly or via 3rd party websites (TV Shows, Movies, ect.)
- File Dump/Mirror Scripts (similar to rapidshare)
- Sites promoting illegal activities
- Commercial Audio Streaming (more than one or two streams)
- Video, Audio Streaming, chats will not be hosted with us, they may be stored from 3rd party
- Mail Bombers/Spam Scripts
- Forums and/or websites that distribute or link to warez/pirated/illegal content
- IRC Scripts/Bots
- Proxy Scripts/Anonymizers
- Pirated Software/Warez
- AutoSurf/PTC/PTS/PPC sites
- IP Scanners
- Bruteforce Programs/Scripts/Applications
- Banner-Ad services (commercial banner ad rotation)
- Escrow/Bank Debentures
- High-Yield Interest Programs (HYIP) or Related Sites
- Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
- Sale of any controlled substance without prior proof of appropriate permit(s)
- Prime Banks Programs
- MUDs/RPGs/PBBGs
- Hateful/Racist/Harassment oriented sites
- Hacker focused sites/archives/programs
- Bank Debentures/Bank Debenture Trading Programs
- Fraudulent Sites (including, but not limited to sites listed at aa419.org & escrow-fraud.com)
- Mailer Pro
Any account found connecting to a third party network or system without authorization from the third party is subject to suspension. Access to networks or systems outside of your direct control must be with expressed written consent from the third party. The hosting provider donevhost.com may, at its own discretion, to request and require documentation to prove access to a third party network or system is authorized.
We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice.
Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists", purchased lists, and selling of lists will be treated as SPAM. Any user who sends out SPAM will have their account terminated with or without notice.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, phone, postal mail, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
The hosting provider donevhost.com reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
Resource Usage
User may not:
1) Use 25% or more of system resources for longer then 90 seconds. Activities that could cause such problems include, but are not limited to: CGI scripts, FTP, PHP, HTTP, etc.
2) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
3) Run any type of web spider or indexer (including Google Cash / AdSpy).
4) Run any software that interfaces with an IRC (Internet Relay Chat) network.
5) Run any bit torrent application, tracker, or client.
6) Participate in any file-sharing/peer-to-peer activities.
7) Run cron entries with intervals of less than 15 minutes.
8) Run any MySQL queries longer than 15 seconds. MySQL tables should be indexed appropriately.
9) You may use your account for personal use, but not as a backup facility for automated backups or things of that nature. If you’re unsure if your intended use violates this TOS please contact us so we can clarify it for you.
10) Intentional misuse of system resources, including but not limited to employing programs that consume excessive network capacity: CPU cycles or disk IO.
11) All hosting packages are limited to 500,000 inodes.
12) Your account may not be used as a storage and/or backup space for files/archives. Regular backups of databases, websites, etc. are permitted within reason. Any account found to be using an excessive and/or unreasonable amount of disk space may be asked to reduce their usage or face suspension/termination. We reserves the right to suspend/terminate any service for resource abuse at their discretion.
Liabilities
Inappropriate behaviour by any individual customer in view of fulfilling or following any part of the above terms and conditions shall result in deactivation of the account in question. The hosting provider donevhost.com shall be the sole arbitrator in view of determining any breach of the terms and conditions.
In no case, when the account has been terminated due to a violation of its holder, the hosting provider donevhost.com shall be taken responsible to refund the amount paid and this shall be to the account of the unconscientious customer.
